1. Agreement
These Terms of Service ("Terms") govern your use of the CleanUpX iOS app ("the App") published by Almavira Labs ("we", "us", "our"). Almavira Labs is a trading name of sole proprietor (FOP) Yevhenii Krysiuk, registered in Ukraine (Unified State Register record No. 22230000000028141). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.
These Terms work alongside our Privacy Policy, which is incorporated here by reference.
2. Description of the service
CleanUpX is an iOS application that helps you tidy up your iPhone — finding duplicate and similar photos, blurry shots, screenshots, screen recordings, large videos, and other items you may want to clean up. The App also includes video compression, contacts cleanup, a PIN-protected Secret Space for private media, storage insights, home screen widgets, and an AI-powered assistant for Pro subscribers.
All photo, video, and contact analysis runs on your device.
3. Licence
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the App on Apple-branded devices that you own or control, for personal, non-commercial purposes, in accordance with these Terms and the Usage Rules set out in the Apple Media Services Terms and Conditions.
4. Account and eligibility
The App does not require you to create an Almavira Labs account.
You must be at least 13 years old (or the equivalent minimum age in your jurisdiction) to use the App. If you are using the App in a region with a higher minimum digital consent age (e.g., 16 in parts of the EU), you must meet that minimum.
5. Subscriptions, payments, and refunds
5.1 Subscription plans
The App offers optional Pro subscription plans (weekly, yearly, and lifetime tiers). Pricing is displayed in the App at the time of purchase and adapts to your local Apple App Store storefront.
5.2 Free trial
Selected subscription plans may include a free trial period. If a trial is offered and you start it, you will not be charged during the trial. You can cancel any time before the trial ends to avoid charges. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the displayed price.
5.3 Auto-renewal
Recurring subscriptions (weekly, yearly) renew automatically at the end of each billing period unless cancelled at least 24 hours before the period ends. The renewal amount will match the displayed price unless we notify you of a change in advance. You can manage and cancel your subscription at any time in your Apple ID Settings → Subscriptions, or by following Apple's official guidance.
5.4 Lifetime plan
The Lifetime plan grants you Pro access for the lifetime of the App in the Apple App Store. It is a one-time purchase with no recurring charges.
5.5 Refunds
All payments are processed by Apple via the App Store. Refunds are issued by Apple under its refund policy. To request a refund, contact Apple Support at reportaproblem.apple.com.
Almavira Labs cannot directly process refunds for App Store purchases. If you encounter a problem we may be able to help resolve, please contact us at support@almaviralabs.com.
5.6 Statutory rights
Nothing in these Terms limits any non-waivable statutory rights you may have as a consumer under the laws of your jurisdiction, including the Australian Consumer Law, the UK Consumer Rights Act 2015, and equivalent legislation.
6. Third-party services
The App integrates with third-party services — including Google (Firebase Analytics), PostHog (product analytics), AppsFlyer (install attribution), Anthropic and Google Gemini (for the AI Assistant), Apple (for App Store and StoreKit), and Cloudflare (for our backend proxy). Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services or their content.
7. Acceptable use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to reverse-engineer, decompile, or extract the source code of the App, except where this is expressly permitted by applicable law
- Use the App to access, scan, or modify data you do not have a right to access
- Interfere with the App's security or attempt to bypass any access or rate limits
- Abuse the AI Assistant feature (including but not limited to: large-volume automated requests, attempts to extract our system prompts or model weights, attempts to use it for illegal purposes)
- Resell or redistribute the App or any portion of it
We may suspend or terminate your access to Pro features if we determine, in good faith, that you have violated these Terms.
8. Intellectual property
The App, its design, source code, content, branding ("CleanUpX", "Almavira Labs", and associated logos), and underlying intellectual property are owned by Almavira Labs or its licensors and are protected by copyright, trademark, and other laws. Nothing in these Terms grants you a licence to use our trademarks, branding, or proprietary code beyond what is necessary to use the App for its intended purpose.
9. Disclaimers
The App is provided "as is" and "as available". To the maximum extent permitted by law:
- We do not guarantee that the App will be uninterrupted, error-free, or completely accurate in detecting duplicates, similar photos, blurry shots, or other items.
- You are responsible for reviewing items the App identifies as cleanup candidates before confirming any deletion, and for maintaining backups of important photos, videos, and contacts. Once you confirm a deletion of photos or videos, it is irreversible by us — items may be recoverable for a limited time from your iOS Photos "Recently Deleted" album. Deleted or merged contacts cannot be recovered — iOS Contacts has no "Recently Deleted" folder.
- Video compression creates a compressed copy and, where you confirm it, removes the original from your library. Compression reduces media quality; this is inherent to how compression works and is not a defect.
- Secret Space content is stored only on your device and protected by your PIN. If you forget your PIN or delete the App, we cannot recover Secret Space content.
- The App does not guarantee a specific amount of storage will be freed.
- AI Assistant responses are generated by third-party AI providers and may contain errors. Do not rely on AI Assistant guidance as a substitute for professional advice.
10. Limitation of liability
To the maximum extent permitted by law, Almavira Labs is not liable for any indirect, incidental, special, consequential, or exemplary damages arising from your use of the App, including but not limited to lost data, lost photos, lost profits, or any loss arising from your inability to use the App.
Where liability cannot be excluded under applicable law (including non-excludable consumer guarantees under the Australian Consumer Law and equivalent legislation in your jurisdiction), our liability is limited to the maximum extent permitted by that law, and where applicable, to refund of fees paid by you for the App in the twelve (12) months preceding the event giving rise to the claim.
11. Apple App Store terms
The App is distributed through the Apple App Store. The following terms apply in addition to the rest of these Terms:
- These Terms are concluded between you and Almavira Labs only — not with Apple. Almavira Labs, not Apple, is solely responsible for the App and its content.
- Almavira Labs, not Apple, is solely responsible for maintenance and support of the App. Apple has no obligation to furnish any maintenance or support services for the App.
- In the event of any failure of the App to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- Almavira Labs, not Apple, is responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
- In the event of a third-party claim that the App infringes that third party's intellectual property rights, Almavira Labs, not Apple, is responsible for the investigation, defence, settlement, and discharge of such claim.
- You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, may enforce these Terms against you.
12. Termination
You may stop using the App at any time by uninstalling it and (if applicable) cancelling your Pro subscription through Apple. We may terminate or suspend your access to Pro features (or the App, if we discontinue it) if you materially breach these Terms. Sections that, by their nature, should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will continue to apply.
13. Governing law and disputes
These Terms are governed by the laws of Ukraine. Any disputes arising from or relating to these Terms or your use of the App will be subject to the exclusive jurisdiction of the courts of Ukraine, subject to any non-waivable rights you have under your local consumer protection laws.
Before initiating any formal dispute, we ask that you contact us at support@almaviralabs.com so we can attempt to resolve the issue in good faith.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be highlighted in the App or notified to you by email if you have provided one. Continued use of the App after the changes become effective constitutes your acceptance of the updated Terms. If you do not agree, you can stop using the App and (if applicable) cancel your Pro subscription.
15. Miscellaneous
- Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
- No waiver. Our failure to enforce any provision of these Terms is not a waiver of that provision.
- Assignment. We may assign these Terms in connection with a merger, acquisition, or sale of assets. You may not assign your rights or obligations under these Terms.
- Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Almavira Labs regarding the App.
